Hi,
I graduated with Masters in Dec 2008. We have 29 month OPT. My OPT ends in June 2011.
So, I believe we have 3 chances for applying for H1
April 2009
April 2010
April 2011
I have not applied in 2009 and will not apply in 2010.
If I apply for April 2011, will I have any trouble, as my F1 ends in June 2011. I guess H1 starts in October. So, in between June and October , will I need to travel out of country . My University says, it will not be trouble. Please explain.
Thanks
Santosh

Here is a scenario:
Previous I 140 (EB2 PD Sept 2005) approved and is now current
Current I 485 filed based on another I 140 with PD in Dec 2006.
Can port over to the previous I 140 and can make I 485 current. The issue here is still unmarried so would like to hold on for few months to port over the PD.
Do you see an issue if porting is not done from EB2 Dec 2006 to the PD in EB2 Sept 2005?
How does it work if married after 3-6months and then want to port the PD for the spouse as well? Does Previous I 140 PD current still hold good?
If retrogression occurs once again do u still need to wait to port and get Green Card

Just released from the Press Secretary's Office: In June, I met with members of both parties, and assigned Secretary Napolitano to work with them and key constituencies around the country to craft a comprehensive approach that will finally fix our broken immigration system. I am pleased to see that Senators Schumer and Graham have produced a promising, bipartisan framework which can and should be the basis for moving forward. It thoughtfully addresses the need to shore up our borders, and demands accountability from both workers who are here illegally and employers who game the system. My Administration will be consulting...

The Chief of Staff of U.S. Citizenship and Immigration Service’s (USCIS) Fraud Detection and National Security (FDNS) office explained three different types of site visits being conducted by USCIS.
Risk Assessment Program Fraud Study: program is part of a study to help design profiles of potential fraud. Family-based petitions or employment-based petitions once approved are randomly selected.
Targeted Site Visits: this visit is to ask questions when fraud is suspected. Advance notice of visit is given.
Administrative Site Visits: for religious worker and H-1B programs. Specific questions generally regarding the beneficiary’s job duties as stated in the petition and whether the beneficiary is receiving the wage as stated on the petition.
More information on the site visits is available at www.uscis.gov (http://www.uscis.gov).

Hi,
I've been working full-time on EAD for the last 2+ years. I have a pending 485 application, on which my spouse is the primary applicant. I have never applied for H1B in the past, because I transferred directly from F1 (student visa) to this EAD.
My spouse also has an H1B, which is in it's 7th year (completed 6 yrs of H1B).
My spouse has been put on furlough (unpaid leave) for 3 months.
What are our options ?
1. Can my employer file H1B for me, and an H4 for my spouse ? How will this affect our green card application (on which my spouse is primary applicant) ?
2. How much time does my spouse have to look for another job (with similar job description), without being out of status ? Is there some grace period associated with H1?
Thanks

Gurus,
here is my situation.
FP done in Nov 2007. Planning a trip to India in Dec 2008 to Jan 2009. What if I receive biometrics during this time? After 1 year of FP, I anticipate that there would be repeat Biometrics done.
Is there a way for us to request Biometrics early? I am going to renew EAD and AP 4 months before expiry (expire in Nov 2008). Will this take care of Biometrics renewal as well?
Thanks for your valuable inputs.

Anti-Immigrants are spreading their message on prime time TV.
I was watching CNN and all of a sudden there was this ad by http://www.american***ker.org( I dont want to advt for them)
May be this msg is old, but I saw this for the first time today and it left a bad taste in my mouth.
What was sad about the whole thing was that the message was so misleading that even the average Joe out there would blindly believe this msg. The antis clearly hid the facts and rode heavily on the unemployment wagon, eventually blaming foreign workers for all their misery.
Oh God save legal immigrants!!!

Hi,
The company I am working for is filing for GC.
They have posted an ad,and all the mandatory work is done.
HR up here have received some resumes for this ad.
After reviewing these resumes, attroney says they may have to place a new ad, as they have recieved a resume which qualifies the position from a local person.
I spoke to my manager and he says the same thing. He told me he did not even interview the local guy who applied.
Is this the only way out of this position. Please advise.
Thanks,

There is no question that the current economic malaise is a major factor in the current demand being short of the H-1B supply. (As of June 18, 2010, 22,900 regular cap petitions and 9,700 masters degree exemption petitions have been received by USCIS). But, as reported in one of the authors previous blogs, the state of our economy is but one of the reasons for the decrease in H-1B usage. Perhaps another reason is an employers ability to make use of a relatively recent DHS rule which permits an F-1 visa holder working pursuant to OPT to extend such OPT...

Sorry for the cross posting.
My papers were sent on June 21st, but they were receipted only on June 27th. Turns out USCIS returned my $1000 for premium processing :(.
My lawyer said they talked to USCIS and USCIS asked them to re-file with proof of receipt.
Did anyone who filed in end June have their 140 premium processing returned?

Recently I have travelled to USA on B1, during port of entry at chicago the immigration officer as marked Advised on the stamp with pen. What does it mean? Does this will have any impact on my next visit to USA on B1.
In port of entry letter I have mentioned stay duration as 4 weeks (1 month). Is this the problem? If so why officer given i-94 till 3 months?
Thanks in advance,
